While Art. 9(3) Aarhus Convention and Art. 47 of the EU Charter of Fundamental Rights provide broad access, the German Climate Protection Act (KSG), section 4(1) sentence 6, excludes subjective climate change rights. The study shows that individual climate change protection exists at all levels and that section 4(1) sentence 6 KSG is incompatible with EU and international law.
